Rules & Waiver

If any of these rules are broken, restriction of access to the facility and fees will be determined by a representative of Turtle Bay.

General Rules

Turtle Bay reserves the right to refuse access to anyone.
Persons under the age of 18 must be accompanied by an adult owner of Turtle Bay who is 18 years or older.
Appropriate attire must be worn.
1. No jeans or T-shirts in the swimming pool or hot-tub
2. Appropriate shoes must be worn in the fitness room.
No alcohol or smoking on the premises.
No pets in the clubhouse.
Any damages to the building or items in or part of the building will be the responsibility of the individual member(s) that caused such damage or who were negligent.
If anything is damaged or broken, it must be reported to Turtle Bay as soon as the damage(s) is/are noticed.
If you open it when you arrive, close it when you leave.
If you turn it on when you arrive, turn it off when you leave.
If you make a mess, clean it up.
Whenever you open the pool cover, turn on the main exhaust fan and the new skylight exhaust fans – turn off when you leave.

Pool Rules

There is no lifeguard on duty. Swim at your own risk.
All swimmers must shower BEFORE entering the pool.
Do not use the pool if you have an open wound or an infectious disease.
Children under 2 must wear a swim diaper and plastic pants.
No running or rough play allowed.
No standing/diving on the metal cover protector at the West side of the pool.
NO DIVING off of the end of the slide.
All glass containers are prohibited on the premises.
Please no food near the spa or pool.
Turtle Bay is not responsible for anything lost, stolen or damaged.

Weight/Fitness Room Rules

Work out at your own risk.
Appropriate attire must be worn.
1. Shoes
2. No swimming suits
All adults are responsible for their own children.
Please be considerate and wipe down equipment after use.
Please no food in the weight room.
Workout equipment and any free weights are NEVER to leave the weight room for any reason.
Any damages to the building or items in or part of the building will be the responsibility of the individual member(s) that caused such damage or who were negligent.

Guest Rules

Guests shall always be accompanied by an owner who is 18 years or older.
Guests shall be aware of and assume all risks associated with using the Turtle Bay Clubhouse facility.
Guest Release of Liability shall be filled out and signed before use of the facility.
1. For those persons under 18, the parent/guardian shall fill out a release of liability.
2. This can be completed in the section below.
Guests shall be considerate of other members who are using the facility and shall obey all rules posted/written in association with the clubhouse.

RELEASE OF LIABILITY FOR TURTLE BAY CLUBHOUSE*
READ CAREFULLY-‐ THIS AFFECTS YOUR LEGAL RIGHTS
In exchange for participation in the activity of use of the weight/fitness room, pool, hot tub, and tennis court or any other equipment that my be placed on the facility organized by Turtle Bay Clubhouse, LLC ("Turtle Bay"), of 2686 Bungalow Dr., Ammon, Idaho, 83401 and/or use of the property, facilities and services of Turtle Bay, I agree for myself and (if applicable) for the members of my family, to the following:
1. I agree to observe and obey all posted/written rules and warnings, and further agree to follow any oral instructions or directions given by Turtle Bay, or the employees, representatives or agents of Turtle Bay.
2. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Turtle Bay for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Turtle Bay, whether caused by the fault of myself, my family, Turtle Bay or other third parties.
3. I agree to indemnify and defend Turtle Bay against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Turtle Bay.
4. I agree to pay for all damages to the facilities of Turtle Bay caused by my or my family's negligent, reckless, or willful actions.
5. Any legal or equitable claim that may arise from participation in the above shall be resolved under Idaho law.
6. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.
7. This Agreement and each of its terms are the product of an arms' length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, Language, or provision giving rise to such ambiguity.
8. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
9. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
I have read this document and I understand it. I further understand that by signing this release, I voluntarily surrender certain legal rights.
